Firespot

Terms of use

Parties

This agreement shall define terms of the relationship between Rayner Software LLC ("Firespot","Rayner Software"), and the user of the NetShade service ("user", "client", "you").

Data

Firespot data is meant to be as current and accurate as possible, but Firespot is not a substitute for official alerts and evacuation notices. Data in the Firespot app is retrieved from multiple public-domain databases, and processed by the Firespot server. Data is refreshed every 5 minutes.

Communications

Under these Terms, you consent to receive communications from Rayner Software electronically. We will communicate with you by email or by posting notices in the Firespot app. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

Indemnification

You agree to indemnify and hold Rayner Software, and its affiliated companies, and its suppliers and partners, harmless from any claims, losses, damages, liabilities, including attorney’s fees, arising out of your use or misuse of the Firespot Service, violation of these Terms, violation of the rights of any other person or entity, or any breach of the foregoing representations, warranties, and covenants. Rayner Software reserves the right, at our own expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us and you agree to cooperate with our defense of these claims.
